Peter Mallory’s trial continued Monday with the testimonies of former TV-33 employees who had worked for Mallory.

The LaGrange Daily News will not identify victims in this case.

Stephen Lee, one of the prosecuting attorneys in the case, began the day by questioning a former TV-33 employee.

The female identified herself in many of the images and clips that were shown in court. The images were taken from a video from a camera hidden under Mallory’s office desk. She said that she never gave Mallory permission to record her, neither was she aware that the recordings were being done.

“It wasn’t where I would expect a camera to be,” said the witness after describing the camera being aimed at the seat area of the chair. She did note that Mallory had told everyone at the station to be cautious about any mics that may be left on.

After identifying pictures of two computers on Mallory’s desk, she said that she would use the computer on the right side of his desk on occasions, and was under the impression that the computer on the left didn’t work because it was never on and never saw him using it.

The second witness, also a former employee and victim of the hidden recordings, was asked about her knowledge of the hidden camera. She was visibly upset when viewing the images of her taken from under Mallory’s desk.

The witness said she would occasionally bring her juvenile daughter to the studio at times, who also was identified in some of the images and is a witness in the case. Her daughter referred to Mallory as the “crazy uncle,” and said that she would play games on a computer on the right side of Mallory’s desk.

The juvenile identified herself in more than 15 images, one of them containing an image of Mallory standing behind her with his hands on her shoulders. She said that Mallory sometimes would playfully pinch her on the neck if she would not get up when he needed to use the computer. The daughter said that Mallory told her to be aware that she might be recorded while there, but she was aware that it would only be in the studio.

Other employee witnesses said they never used the computer on the left. One of the witnesses said that Mallory told her that the computer was not working and had a virus on it. The computer was normally turned off, according to most witnesses.

Russell Smiley, a former employee testified that he was using the computer on the right one day when he accidentally bumped the mouse of the left computer. The screen came on and he saw lines and captions of what looked like child porn. He described seeing the words “Kathy pre-teen, young, boy, girl, pre-teen, young female models, little, gay, boy-boy, girl-girl.” He remembered scrolling down and seeing hundreds and hundreds of titles that he described as very graphic and very pornographic.

The witness admitted that he did not want to be involved what he saw, and after he was interviewed by police he told them he did not think it had anything to do with children.

Once he was questioned by Ed Garland, defense attorney, the witness said that he was unsure if the computer was downloading at the time and he never saw Mallory on the computer.

Several law enforcement officers were brought in to identify images of child porn that were found on Mallory’s drives involving cases that they had previously worked on.

The trial was expected to continue today at 9 a.m.
