Prosecutors said Chad Moman was leaving the Fairwood Trailer Park off Whitesville Street with his cousin, who had just purchased drugs there, when he backed out at a high speed and ran into Odaliesa Deleon-Velasco. The child died of head trauma which an autopsy report said was “consistent with being crushed by a vehicle,” prosecutors said. Impact was hard enough to break the tricycle Odaliesa was riding into three pieces, and Moman attempted several times to leave the scene before police arrived.
Moman, 28, of Jarrell Hogg Road was sentenced Wednesday by Troup Superior Court Judge Allen Keeble. He appeared before the court in black and white jail scrubs. He’s been in Troup County Jail since he was denied bond after the incident. He was given a sentence of 15 years for homicide by vehicle, but will serve 10 years in the plea agreement. He also will serve two years of a four-year sentence for fleeing the scene of an accident.
Odaliesa’s father, DeLeon Martinez, spoke to the court through an interpreter.
“We are dead in our own lives,” Martinez said.
He and his wife have two other children, both of whome witnessed Moman’s crime. Odaliesa died on the way to West Georgia Medical Center.
“We’re asking that justice be served,” said Martinez, who was at Moman’s sentencing with his wife. “He could have avoided it.”
Members of Moman’s family also spoke to the court and to Odeliesa’s parents.
“It was a terrible accident. I know you’re suffering,” said Patricia Smith, Moman’s aunt. “I don’t know what to say. He was a good-hearted, fun person. There’s no way he’d do this on purpose.”
