Authorities have decided not to prosecute a West Point city councilwoman who was arrested last year for serving customers a drink called a mimosa at her Columbus bridal shop.
The drink contained champagne and orange juice, and Columbus authorities said Judy Wilkinson violated the law because she did not have a license to sell alcoholic beverages.
Solicitor General Ben Richardson said Wilkinson had no criminal record and qualified for “deferred prosecution.” She will have to perform 20 hours of community service for a nonprofit agency.
Wilkinson’s arrest sparked complaints from some residents who said undercover police officers have more important crimes to worry about than a bridal shop owner giving customers a free drink.
Wilkinson was found guilty in November of violating the city’s alcohol ordinance. She was given a sentence of 30 days’ probation on the misdemeanor charge but no monetary fine.
Reports said six officers showed up at Formal Elegance, a bridal and formal wear shop on Veterans Parkway, to perform a “business check” after receiving a complaint that alcohol was being served.
Police said Wilkinson “offered and had an employee serve a mimosa,” without having an alcohol license for the business.
Her attorney, Benjamin Wilcox, said he interpreted the city ordinance to allow alcohol to be served as long as it isn’t sold.
Wilcox said his client specifically asked about being able to serve alcohol when she renewed her business license this year. Wilkinson picked up the application, then took it back to ask a clerk if she should check a box on the form asking if she’d be selling or consuming alcohol, her attorney said.
The clerk told Wilkinson not to bother checking the box, even when she explained the type of event she’d be hosting, Wilcox said.
